A LACK of evidence to determine who shot a duck hunting protester in the face near Donald will result in no charges being laid.
St Kilda woman Julia Symons was shot in the face with several pellets during Victoria's duck hunting opening at Lake Buloke, in the state's north west.
At the time, witnesses told the media they saw a 14-year-old boy taunting the victim before the accident.
Sgt Jeremy Cook, of Donald police, said a prosecutor had reviewed the evidence collected and decided there was insufficient evidence to lay charges.
"The main contention was the actual person that fired the shot that hit the lady," Sgt Cook said.
He said in court police had to prove beyond a reasonable doubt that the person charged had committed the offence.
He said 10 witness statements had been collected.
Sgt Cook said the teen and his uncle told police they had not fired a shot for sometime but that was disputed by some of the other witnesses.
Parties involved in the case have been notified of the prosecutor's decision.
Sgt Cook said the prosecutor would like to see safety improvements on the opening of duck shooting season.
One recommendation includes sending the file to the Victorian Government to consider legislation about what angle shooters should fire above to avoid risks.
